“It was only a joke.”

How many times have you heard that in the workplace?

A GIF. A meme. An emoji. A message in a WhatsApp or Teams group chat.

Something intended to be funny can quickly become something much more serious - and one recent employment tribunal case is a perfect example.

In Ursuleanu v Vicars Cross Healthcare Ltd & Others, an employee was awarded almost £14,000 after a tribunal found that a GIF sent by a colleague amounted to harassment related to sex.

But if you read the headline - “Tribunal ruling highlights dangers of sending GIFs at work” - you might think the lesson is simply:

Don't send GIFs to your colleagues. It isn't.

In this session of our “What Can We Learn From Tribunal?” Masterclass Series, we'll go beyond the headline and take the judgement apart.

We'll look at:

  • What was actually said and sent
  • The context surrounding the GIF
  • Why the tribunal rejected the argument that it was “just a joke”
  • Why the employee's sex was relevant to the finding of harassment
  • The significance of the previous “Putin” comment
  • How the employee's reaction and the surrounding circumstances affected the tribunal's assessment
  • What employers should do when inappropriate workplace messages are raised
  • Whether your workplace policies and training are actually doing enough to prevent this type of conduct

We'll cut through the sensationalist headlines, examine what the tribunal actually considered and pull out the practical lessons HR teams, managers and business owners can apply in their own workplaces.

Join us and find out what this tribunal decision can actually teach you about workplace harassment, banter, employee conduct and managing risk.
